Kukaret Heavy Industries & Virtua Rasa Privacy Policy

This Privacy Policy (“Privacy Policy”) explains the collection, use, processing, transferring, and disclosure (“Data Use”) of “personal information” by Kukaret Heavy Industries LLC (“Kukaret”), through the websites that Kukaret operates at kukaret.com (together with all sub-domains thereof, and the websites available at domain names or sub-domains of virtuarasa.com; collectively the “Websites”). This Privacy Policy also applies to all products, information, and services provided through the Websites (collectively, the “Services”). This Privacy Policy also contains an Express Consent that applies to those who use our Websites and Services (as defined below). This Privacy Policy is incorporated into and made part of the Kukaret Terms of Use located at http://virtuarasa.com/terms.html.

This Privacy Policy also explains our commitment to you with respect to our Use of non-personal browsing and site usage data that Kukaret collects as the provider of the Websites. “Non-personal browsing and site usage data” refers to information that Kukaret collects indirectly and automatically about your activities while visiting the Websites and using the Services through analytics tools. The type of information that we collect focuses on general information, such as your general, and not intentionally fine-grained, location, pages visited, a heat-map of visitors’ activity on the site, information about the browser you are using, etc. In addition, whenever you use our Services, our servers (which may be hosted by a third party service provider) keep a plain text log of the websites you visit and when you visit them. Kukaret does not deliberately track people over the Internet. See “Non Personal Browsing and Site Usage Information,” below, for more information about this.

This Privacy Policy does not apply to any of the websites operated by affiliates or partners of Kukaret unless expressly provided on those websites.

As used in this policy, “personal information” means information that would allow a party to identify you such as, for example, your name, address or location, telephone number, or email address, or information from which a person could accurately deduce your identity.

By accessing the Websites or using any of the Services, you are accepting the practices described in this Privacy Policy.


Our Principles

Kukaret is committed to handling responsibly the personal information and data we collect about you through our Services, whether personal information or non-personal browsing and site usage data. We have designed our Privacy Policy consistent with the following principles (the “Principles”):

  1. Privacy policies, including provisions regarding Data Use, should be human readable, comprehensive, and easy to locate;
  2. Only the minimum amount of personal information reasonably necessary to provide you with services should be subject to Data Use, and only for so long as reasonably needed or required, consistent with the principles of proportionality and data security; and
  3. Information you provide through our Services, or that we gather as a result of your use of our Services, should not be provided to a third party without your permission, unless required.

What Kukaret does with the Personal Information

Emails and Newsletters

We use the personal information you provide to us when you send us emails or when you subscribe to our newsletter or product offerings, in order to respond to your request — for example, to reply to your email, to send you information about news and events related to Kukaret, or to describe products provided by Kukaret.

When you subscribe to a newsletter, events list, or an email discussion list, your name and email address is sent to and stored by Kukaret or its contractors. Personal information submitted as part of our email discussion lists is used for the purpose managing the discussion lists. Your name and email address may be visible to other list participants if you correspond on the list or to the general public in discussion archives. All emails sent to discussion lists may be publicly archived.

You may always unsubscribe to our newsletters, events lists, or email discussion lists. By creating an account, you agree that we may email you about issues critical to your privacy, or to confirm account changes, even if you have otherwise unsubscribed from our email lists.

Purchases

When you purchase merchandise, we will use your personal information for the purpose of sending you the items or providing to you the services you purchased. This includes communication via telephone, email, US Mail, or other carrier, to confirm purchase quantities, costs, and shipping methods. Your personal information will also be used for to complete and to process your payment.

If you choose to pay for purchases or subscribe to services from Kukaret via a third-party payment processor, including PayPal, Amazon Payments, Patreon, or the US banking system, your personal information may be sent to, handled by, or stored by those entities in accordance with their respective privacy policies and terms of use. You should read and understand the privacy policy and terms of use of any method you use to purchase merchandise or services from Kukaret.

Kukaret does not store your credit card number, bank account number, or other identifiable banking information. We do store the minimum data provided by the payment processor in order to successfully complete the transaction and correlate your payment to your purchases or subscriptions, and whatever information the processor requires us to maintain to aid them in preventing fraud or abuse.

When you purchase merchandise, products, or services from Kukaret, we may use your name or your company’s name on a list of clients unless you request otherwise in writing.

Any other personal information that we may collect which is not described specifically in this Privacy Policy will only be collected and used in accordance with the Principles.


Disclosures of Personal Information

In general, it is not Kukaret’s practice to disclose personal information to third parties, other than as made available on the Services in the course of their use. We may share personal information in the following instances:

  1. Your username may be made public.
  2. Data you provide to us regarding virtual objects, including, but not limited to, their titles, names, descriptions, iconography, or statistics may be made public.
  3. Kukaret may share personal information with our contractors and service providers in order to maintain, enhance, or add to the functionality of the Websites.
  4. Kukaret may disclose your personal information to third parties in a good faith belief that such disclosure is reasonably necessary to:
    1. take action regarding suspected illegal activities;
    2. enforce or apply our Terms of Use and Privacy Policy;
    3. comply with legal process, such as a search warrant, subpoena, statute, or court order; or
    4. protect our rights, reputation, and property, or that of our users, affiliates, or the public.

Kukaret Heavy Industries has not received any search warrants, subpoenas, statutes, or court orders, as of the effective date of this Privacy Policy.


Security of Personal Information Collected via the Websites

Kukaret has implemented industry-standard measures to protect against unauthorized access to and unlawful interception or processing of personal information that Kukaret stores and controls. However, no system can fully eliminate security risks. Third parties may circumvent our security measures to unlawfully intercept or access transmissions or private communications.


Non-Personal Browsing and Site Usage Information

Our Data Usage Policy covers how we maintain and use information about you that is collected by our Websites and server logs.

Non-Personal Information We Collect

When you use the Websites, our servers (which may be hosted by a third party service provider) may collect information indirectly and automatically (through, for example, the use of your “IP address”) about your activities while visiting the Websites and information about the browser you are using.

No Linking

We do not intentionally link browsing information to the personal information you submit to us. We use this information for internal purposes only, such as to help understand how the Websites are being used, to improve our Websites and the features we provide, and for systems administration purposes. Kukaret may use a third party analytics provider to help us collect and analyze non-personal information through operation of our Websites for those same purposes.

No Selling or Sharing

Except in the unique situations identified in this Privacy Policy, Kukaret does not sell or otherwise voluntarily provide the non-personal information we collect about you or your usage of the Websites to third parties.

No Retention

Kukaret automatically discards non-personal information from our server logs once we have used the information for the limited purposes noted above, under “No Linking.”

Any other non-personal information that we collect which is not described specifically in this Privacy Policy will only be collected and used in accordance with the Principles.


Other Non-Personal Information

The following data are not considered Personally Identifiable Information (“PII”) and may be disclosed publicly:

Usernames
You are encouraged to pick a username that, although unique, does not reveal your PII if disclosed. Usernames may be revealed to other users of the system in the course of your or their use of the Services we provide. We may prevent previously reserved usernames from being reissued, but if we do, we will not associate those usernames with any individual after their account has been terminated.
Various Service-Specific Descriptions
The Services we provide allow users to define virtual objects, including, but not limited to, objects we call “worlds,” “maps,” and “units.” Additional virtual objects may be included as the Services are improved. These data are not PII and may be revealed during the course of providing the Services.
Your Connection Status
Other users may be able to see that you are using the Services, including the time and date of your activity.
Information You Upload to a Service
Part of our Services may include one or more wikis, discussion forums, chat rooms, or similar interactive records. Your contributions to these records may be published publicly and associated with your username.

Cookies and Other Technologies

We use “cookies” to manage your logins. Our third-party payment processors or analytics providers may also use cookies or other technology to manage your logins or collect analytical data. Cookies are short lengths of data stored on your computer which are provided to us on each request. If you turn off the storage or use of cookies in your web browser, you may not be able to log in or use our Services. Cookies do not inherently contain PII, but allow us to correlate your computer’s access of our site with your account.

More information on our cookie policy is available in our Cookie and Local Storage Use Policy. In the event of a disagreement between the policies, this Privacy Policy shall prevail.


Reorganization or Spin-Offs

Kukaret may transfer some or all of your personal and/or non-personal information to a third party as a result of a reorganization, spin-off, or similar transaction. Upon such transfer, the acquirer’s privacy policy will apply. In such event, Kukaret will use reasonable efforts to notify you and to ensure that, at the time of the transaction, the acquirer’s privacy policy complies with the Principles and with all applicable laws.

Children

The Services are not directed at children under the age of 13. Consistent with the U.S. Federal Children’s Online Privacy Protection Act of 1998 (COPPA), we will never knowingly request personal information from anyone under the age of 13 without requiring parental consent. Our Terms of Use specifically prohibit anyone using our Services from submitting any personally identifiable information about people under 13 years of age. Any person who provides their personal information to Kukaret through the Services represents that they are 13 years of age or older.


Third-Party Sites

The Websites may include links to other websites. You should consult the respective privacy policies of these third-party sites. This Privacy Policy does not apply to, and we cannot control the activities of, such other websites.


Special Notes to International Users

If you are accessing or using the Services in regions with laws or regulations governing data collection, processing, transfer, use, or disclosure that differ from United States laws, please note that we may transfer your information to recipients in countries other than the country in which the information was originally collected. Those countries may not have the same data protection laws or regulations as the country in which you initially provided the information. Accuracy and Retention of Personal Information Collected

Kukaret intends to keep personal information accurate and up-to-date. We retain personal information no longer than is necessary to carry out the purposes described above, or as required by law. If changes need to be made to your personal information, please notify us as soon as possible. If you inform us of changes or we otherwise become aware of any factual inaccuracies in personal information, we will promptly make appropriate changes. You also have the option to update some of your personal information yourself via your Kukaret account.

Along with all other rights granted to you under applicable laws, you may at any time request to be informed of personal information that Kukaret holds. If you wish to access such personal information, you should apply in writing to Kukaret (as identified below, in the “Contact Us” section. You are generally entitled to access your personal information that Kukaret holds and to have inaccurate data corrected or removed, to the extent Kukaret still maintains it. In certain circumstances, you also may have the right to object for legitimate reasons to the processing or transfer of personal information.

We will retain your information as long as your account is active, as necessary to provide you with the Services or as otherwise set forth in this Policy. We will also retain and use this information as necessary for the purposes set out in this Policy and to the extent necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and protect our legal rights.

We may reply to your registered email address, rather than the email address from which you contact us, if they are different. You are responsible for maintaining the accuracy of the information associated with your Kukaret account. If you no longer have access to the registered email address, please inform us promptly. We may require additional verification, in order to ensure that you are authorized to access the personal information you have requested. If we cannot reasonably verify your identity, we may not be able to provide any personally identifiable information.


Changes and Updates to this Privacy Policy

We may occasionally update this Privacy Policy. When we do, we will also revise the Effective Date below. We encourage you to periodically review this Privacy Policy to stay informed about our Data Use of the personal information we collect. Your continued use of the Websites constitutes your agreement to this Privacy Policy and any updates.
